Abstract

Artificial intelligence has transformed the manner in which creative works are produced, reproduced, distributed and exploited in the digital age. In Nigeria, this development has created legal and institutional concerns for enforcing copyright because the existing copyright framework was designed around human authorship and traditional forms of infringement. Indeed, the Copyright Act 2022 introduced important reforms. However, it does not address the challenges which are created by AI-generated works, AI-assisted creativity, automated reproduction of content, large-scale scraping of data, text and data mining, or liability for infringement which arise from AI systems. Therefore,this research examines the challenges in enforcing copyright in the era of artificial intelligence in Nigeria. The specific objectives were to examine the legislative and institutional framework for copyright enforcement, assess the challenges which affect enforcement, and provide recommendations for reform. The study adopted the doctrinal methodology and it relied on statutes, decided cases, international treaties, textbooks, journal articles, policy documents and credible online materials. The research found that Nigeria has a broad legislative and institutional framework comprising the Copyright Act 2022, Cybercrimes Act, Evidence Act, Nigeria Data Protection Act, NITDA Act, AfCFTA Protocol on Intellectual Property Rights, Berne Convention, TRIPS Agreement, WIPO Copyright Treaty, WIPO Performances and Phonograms Treaty, Marrakesh Treaty and Beijing Treaty on Audiovisual Performances. It also found that institutions for enforcement include the Nigerian Copyright Commission, courts, CMOs, NDPC, NITDA, WIPO, WTO, ARIPO, INTERPOL and the Nigeria Police. However, enforcement remains weakened by uncertainty over human authorship, ownership of AI- generated works, legality of AI training on copyrighted materials, absence of text and data mining rules, opacity of AI systems, evidentiary difficulties, cross-border infringement, lack of forensic tools, poor funding, weak coordination among institutions and limited judicial expertise. The research recommended that the law should be amended; there should be clearer rules on AI copyright; Strengthen the capacity of NCC capacity; specialised IP and technology courts should be established; the procedure for digital evidence should be improved; there should be cooperation among agencies; there should also be collaboration on an international scale.
