Abstract
Land registration and title perfection constitute fundamental mechanisms for securing proprietary interests in land and promoting effective land administration. In Nigeria, the legal framework governing land registration and title perfection is principally regulated by the Land Use Act 1978, which vests all land in each state in the Governor to be held in trust for the benefit of the people. Despite the objectives of the Act to ensure orderly administration of land and certainty of title, the processes of land registration and title perfection continue to face significant legal, administrative and institutional challenges. The study adopts the doctrinal research methodology, relying on statutes, judicial decisions, textbooks, journal articles, government publications, and other relevant secondary sources. The research critically analyses the legal principles relating to land registration, title perfection, Governor’s consent, stamping and registration of land instruments, as well as the role of relevant institutions involved in land administration in Enugu State. The study finds that although recent reforms, particularly the introduction of the Enugu State Geographic Information System (EnGIS) and the Enugu State Land Registration Law 2025, have enhanced efforts toward digitisation and modernisation of land administration, several operational and structural challenges remain. These include delays in processing title documents, incomplete and defective land records, inadequate technical capacity, and the high cost associated with title perfection. It recommends the streamlining of administrative procedures, strengthening of digital land administration systems, reduction of transaction costs, improvement of institutional capacity, and harmonisation of land registration processes to enhance the effectiveness of land registration and title perfection in Enugu State and Nigeria generally.
