Abstract

This research examines the legal framework prohibiting same-sex marriage: a comparative study. The study explores how different legal systems regulate marriage and the extent to which same-sex marriage is recognized or prohibited across selected jurisdictions. It further analyses the legal, social, cultural, and moral factors influencing such laws, with particular attention to the interaction between statutory provisions, constitutional principles, and societal values. The objective of the study is to critically assess the legal basis for the prohibition or recognition of same-sex marriage and to compare approaches adopted in different countries. The research adopts a doctrinal method, relying on primary sources such as statutes, case law, and constitutional provisions, as well as secondary sources including textbooks, journal articles, and internet materials. 16 Findings from the study reveal that legal approaches to same-sex marriage vary significantly across jurisdictions, largely influenced by cultural, religious, and historical contexts. While some countries have legalized and recognized same-sex marriage based on equality and human rights principles, others maintain strict prohibitions grounded in public morality and traditional definitions of marriage. The study concludes that the legal treatment of same-sex marriage remains a contested issue in comparative law, reflecting the tension between evolving human rights standards and established cultural and moral norms. It recommends continuous legal analysis and balanced legislative approaches that consider both human rights discourse and societal values within each jurisdiction.
