Abstract

Criminal liability is a fundamental principle of criminal law which outlines the responsibility an offender has with regards to an offence he committed. This study examines criminal liability placed on offenders who commit offences against persons and property under the Nigerian law. The importance of this research lies in the constant commission of offences against persons and property and the challenges which may arise as to the criminal responsibility of the offenders. This is with particular reference to the requirements of actus reus and mens rea and the defences available to be pled by the defendant. The aim of this study is for the purpose of examining the legal framework which governs criminal liability for the crimes against persons and property and the extent to which it is effective in the achievement of justice. The doctrinal method of legal research along with the use of primary and secondary sources including statutes and journal articles, were adopted in this study. The study found that although Nigerian criminal law is extensive in its provisions for the protection of persons and their property, challenges like procedural delays, lack of public awareness and inconsistency in criminal justice administration play down its effectiveness. Legislative review of outdated provisions, improving judicial efficiency and increasing public awareness are some of the recommendations made by this study. To conclude, this study deems it necessary that there be a more effective criminal justice system in order to ensure proper protection of persons and property which will in turn lead to the promotion of public confidence in the administration of justice in Nigeria.
