Abstract
The tests for validity and evidence of Nigerian Customary Law within a plural Legal system The following case study aims at a critical examination of the tests of validity and evidence for Nigerian custom in Nigeria's pluralistic Legal system focusing on family, land and community based issues. This study employs a doctrinal research methodology, relying primarily on secondary sources such as legal texts, case law, statutes, scholarly articles, and legal commentaries to critically analyze the validity and evidentiary tests of Nigerian Customary Law within the plural legal system. The history behind the existing tests for validity for Nigerian Custom in Nigeria's pluralistic Legal system. Eshugbayi Eleko, Mojekwu at all 1876 Supreme Court Ordinance the first test to be relied upon on for Nigerian Custom in Nigeria's pluralistic Legal system will be analyzed. Such questions as Repugnancy Test, the incompatibility test, the public policy test, this study will be analyzed on the basis of four theories i.e. Theory of fact, judicial notice theory of living law and the integration theory to examine Nigerian legal system as been able and willing to incorporate the Nigerian custom as a legal system.
