Abstract

Capital punishment under the Nigerian criminal justice system is constitutional and its persistent practice in Nigeria, is contrary to the trend in world community according to human right concerns. There has been an unending argument on the validity of capital punishment, as it contravenes the constitutional rights to live, human dignity, fair hearing. There is also a universal problem in administration like the excessive and indefinite stay on death row, the acceptance of confessional statement as conclusive evidence. The study also signifies that there has been a significant shift. This study adopts doctrinal research methodology and sources includes primary and secondary source of information. Capital punishment which is still in practice in Nigerian, by the virtue of the provisions of the Constitution and laws, does however create complex legal, moral and human right issues. There has been no sufficient empirically evidence supporting the use of capital punishment to deter crime in Nigeria but however its imposition continues to cause grave human rights violations and there is also risks of miscarriage of justice. This study also found that there has been significant shift toward abolition worldwide, and increasing pressure from the human right communities toward criminal justice reform. It recommends the abolition of capital punishment in Nigeria and the use of alternative measures like life imprisonment or rehabilitation in order to protect human dignity and secure the society.
