Abstract
ABSTRACT The nature, extent, and enforceability of the rights of patients in Nigeria have all been carefully analyzed in this work. Despite the presence of the National Health Act 2014, the Patients' Bill of Rights 2018, and even constitutional rights, the rights of patients in Nigeria remain unenforceable to date. The research highlights essential rights, such as emergency care, informed consent, confidentiality, and respect, while pointing out the weaknesses of their enforceability through the use of the doctrinal approach. Constitutional non-justiciable rights, institutional incapacity, sociocultural barriers, and lack of awareness, among others, form part of the major barriers. Just to name a few, a Patients' Rights Act, constitutional amendments, better enforcement methods, and awareness programs are some of the many changes recommended by the report. It is evident that without institutional and legal change, the gap between progressive legal rights of patients in Nigeria and their actual condition will continue.
