Abstract

ABSTRACT Protection of public officers is a highly contentious issue within the Nigerian legal system. The Nigerian legal system requires provision to be made in order to ensure that public officers receive protection from frivolous suits and other activities that would hinder public officers from carrying out their duties effectively. This is evident in several statutes, including Public Officers Protection Act, Constitution of the Federal Republic of Nigeria 1999 (as amended), Code of Conduct Bureau and Tribunal Act, and Corrupt Practices and Other Related Offences Act. However, even though there might be good reason why such legislative provisions exist from a policy standpoint, what has happened in Nigeria in recent times is that there has been abuse of the statutory protection regime by government officials who use their legal immunities to cover up their corruption and abuses of office. The current judicial trend indicates that the judiciary does not want to be a party to the perpetration of impunity through the statutory protection regime.
