Abstract

The work thoroughly analyses passenger rights in Nigeria’s aviation legal system through analysis of Constitution, Civil Aviation Act 2022, Nigerian Civil Aviation Regulations 2023 (Part 19), Montreal Convention 1999, and Federal Competition and Consumer Protection Act 2018. The use of a doctrinal legal research methodology involves the examination of both primary and secondary legal sources. The analysis shows that although Nigeria has an effective legislative framework for the protection of consumers' rights in air transport which is consistent with international standards, there are huge gaps between the law and its implementation. Main issues include the failure of NCAA's Consumer Affairs Department to enforce the law, ignorance on the part of the passengers about their rights, overlapping jurisdictions of regulatory bodies, non-enforcement of the law by the airlines, and complications in the dual compensation mechanism. Moreover, some possible ways for the redress of consumer complaints against airlines have been highlighted. These include administrative, contractual, statutory, tortious and judicial approaches. To mitigate the above challenges, there are five key recommendations to be adopted, namely: improved budget allocation and resource mobilization by the NCAA, legal interpretations on how the Montreal Convention works with domestic compensation mechanisms, tough burden of proof on extraordinary circumstances, awareness creation in simple English, creation of consumer courts, and promoting institutional cooperation. It is imperative to adopt the above recommendations in solving the challenges.
