Abstract

This study critically examines the appointing powers of the President under the 1999 Constitution with a view to determining the constitutional basis, scope, limitations, and implications of such powers within Nigeria's democratic framework. The study adopts a doctrinal legal research methodology, relying on primary and secondary sources of law. The findings reveal that although the Constitution provides mechanisms such as Senate confirmation, judicial review, and the federal character principle to regulate presidential appointments, these safeguards have not always been effective in preventing excessive executive influence. The study further finds that ambiguities in certain constitutional provisions and political considerations often undermine transparency, merit, and accountability in the appointment process. Comparative analysis of selected jurisdictions demonstrates the importance of stronger institutional checks in maintaining a balance between executive discretion and democratic accountability. The study concludes that while presidential appointing powers remain indispensable to effective governance, their exercise must conform strictly to constitutional principles, the rule of law, and the requirements of transparency, fairness, and national integration. The study recommends constitutional and institutional reforms aimed at strengthening oversight mechanisms, enhancing compliance with the federal character principle, promoting merit-based appointments, and ensuring greater accountability in the exercise of presidential appointing powers.
