Abstract
This research project will consider treason and treasonable felony offences under the criminal laws of Nigeria. It focuses on the history behind these offences, statutes, and the fundamental conflict between state sovereignty preservation and constitutional fundamental human rights protection. The research employs pure doctrinal methodology whereby the primary sources of data include the 1999 Constitution of the Federal Republic of Nigeria, Criminal Code Act, Penal Code Act, Evidence Act 2011, and important decisions made by courts of appeal. The secondary sources of information include peer-reviewed journal articles and books written by legal scholars. From the findings in this research project, it can be established that whereas the relevant statutes give essential measures of protection for the corporate personality and constitutional stability of the state, they have very broad definitions, particularly in reference to the levying of war, overawing and overt act phrases, which create legal confusion. There are historical and current cases in which different administrations use the state security related offences to oppress democracy, free assembly and movements such as the RevolutionNow movement and secessionist activities. Moreover, the comparison between the United Kingdom’s and the United States’ framework further proves that the United States’ system is better protected from political manipulation because of the stringent interpretation of the constitution in terms of actual war. This research therefore recommends immediate changes in legislation by the National Assembly to restrict and define the legal aspects of state security offences in the codes, codification of immunity from prosecution for non-violent political protest, the strict adherence to the two witnesses rule of evidence, and extension of the legal aid scheme for poor suspects charged with treasonable felony.
