Abstract
This research is an examination of custodial and non-custodial sentencing as a means of punishing offenders and rehabilitating them as well. There has been a growing concern about prison overcrowding, recidivism, and the effectiveness of incarceration as the predominant method of sentencing. The question is, has custodial sentencing been effective in the Administration of Criminal Justice in Nigeria, when considering the effect of non-custodial sentencing, which includes probation, community service, fines, and restorative justice initiatives. The study adopts a doctrinal research design, analyzing both primary and secondary sources. It found that while custodial sentencing performs certain roles like rendering the convict incapable of committing another crime by keeping him away from society, it also leads to prison congestion and poor rehabilitation, especially for first offenders. However, non-custodial sentencing facilitates offender reintegration into society. It is cost-effective in terms of correction and eases strain on the prison system, especially for petty offenders. The study finds that insisting on custodial sentencing alone does not aid the administration of the criminal justice system. It recommends the proper use of both methods of custodial and non-custodial sentencing for an efficient justice system in the country.
