Abstract
ABSTRACT A tort known as "malicious prosecution" offers compensation to those who have been the target of baseless lawsuits and legal actions. It is the deliberate injury of another person through the abuse of legal proceedings. It happens when someone intentionally brings wrongdoing against another. There must be evidence that the plaintiff won the original action. This study examined the tort of malicious prosecution, how to prove it, and the problems and difficulties that come with it. The doctrinal approach and conceptual research method are the research methodologies used in this work. According to this analysis, this tort has a poor success rate. There must be evidence for a tort in this case to be successful, that the defendant “set the law in motion”. The research shows the gap in the current legal framework. Some recommendations suggested include relaxation of strict proof requirements, legislative intervention, public awareness, strengthening police accountability, judicial clarification of key concepts, encouragement of alternative claims, provision of adequate compensation, judicial training and sensitisation, as well as balancing public policy and individual rights.
