Abstract
ABSTRACT This study is titled overview of the legal framework governing land transactions in Nigeria. The main objectives is to identify the challenges associated with land acquisition and transfer and assessing the effectiveness of existing laws in protecting the interests of parties to land transactions. Despite the existence of legal frameworks regulating the acquisition, transfer, and registration of interests in land, land transactions in Nigeria continue to be plagued by numerous challenges. These challenges have contributed significantly to the prevalence of land disputes and insecurity of title. The study adopts the doctrinal method of legal research. The study finds that although the Land Use Act and other related laws provide a comprehensive framework for regulating land transactions, several practical and legal challenges continue to undermine their effectiveness. These include bureaucratic bottlenecks in the administration of land, inadequate land registration systems, widespread ignorance of legal requirements, and the persistence of informal and customary land transactions. The study further finds that the requirement of Governor's consent, though intended to regulate land dealings, often causes delays and increases transaction costs. The study recommends, among other things, the reform of land administration processes, the digitization of land registration systems, increased public awareness of legal requirements for land transactions, and a review of the provisions relating to Governor's consent under the Land Use Act. It concludes that effective reform of Nigeria's land administration system is necessary to enhance security of title, reduce land disputes, and promote sustainable economic development.
