Abstract

Enforcing data privacy laws in Nigeria has become a major roadblock in the modern digital era. In today's era, from banking to online shopping, all the activities demand to share personal information, and tech companies and government bodies have huge repositories of personal information. This means that normal people are highly susceptible to identity theft, leaks and unauthorized tracking. While privacy is a right of all people, the current pace of technological development and cross-border data tracking is continually threatening personal security. To be able to unravel this problem, it is necessary to examine the Nigerian laws and legislation, and examine how data protection is handled in Europe and south Africa and point out the gap. While the launch of the NDPA2023 was good, implementation is lagging because there are some structural problems that need to be addressed. They involve regulatory conflicts in which various government departments have overlapping regulations, poorly resourced agencies with no technical tools, untrained lawyers in digital forensics, and the public's lack of understanding, together with a cloud dilemma, making it difficult to track data across borders. To fix the digital economy and to restore public trust, the NDPC needs to be fully free from external interference, mandates from multiple agencies need to be streamlined and merged, judicial training needs to be improved, and public awareness needs to be raised in the grassroots, while forging alliances with foreign versions of the NDPC to monitor data trans-border transference. If the institutions which are supposed to hold violators accountable are weak, then writing the law is useless.
